(“PCG” or “we” or “us”) owns and administers this website (“CapNexus”).  PCG is strongly committed to protecting your privacy online.  We have taken steps to protect the information you share with us by creating this CapNexus Privacy Policy (“Privacy Policy”).  This Privacy Policy describes how we collect, use, share, and safeguard personal information provided to us.

Acceptance of Privacy Policy

By using, accessing, or registering with CapNexus, you signify your agreement to be bound by this Privacy Policy.  If you do not agree to this Privacy Policy, you are not authorized to use CapNexus and you should stop using the website.

Information Collection and Use

PCG may collect information that is associated with a name or personal identity in order to provide you and other users with customized services (e.g., creating a profile), content, and related items.  At times you may be required to submit personal information in connection with the posting or viewing of loans or when you register to use CapNexus.  Examples of personal information that may be provided to us could include name, email address, street address, phone or fax number, professional title, credit card number, and other personal information.  Personal information provided to PCG may be transferred across state and country borders for the purposes of data consolidation, storage, and simplified information management.

When you use CapNexus, we automatically track and collect non-personal information, which is information about website usage and operations that is not associated with a specific personal identity.  Examples of non-personal information include IP address, domain server, type of computer, type of web browser, web pages viewed, usage and browsing habits on the website, and other similar data.  We may also aggregate demographic information collected from our users (e.g., the number of loans, type of loans, or user characteristics).  We may also collect non-personal information about the loans that you are seeking to obtain, make, buy, or sell and other business information.  All of this information is helpful to us for improving your experience on CapNexus, trouble shooting problems, and providing content that is valuable to users.

We may also use “cookies” to provide customized content specific to your interests and store your password so that you do not need to re-enter it each time you visit CapNexus.  "Cookies" are pieces of information that may be placed on your computer by a website for the purpose of facilitating and enhancing your communication and interaction with the website.  Cookies will not be used by us to automatically retrieve personal information from your computer without your knowledge.

Sharing Information

PCG will not sell, rent, or lease your personal information to others.  We will not disclose personal information to third parties without your permission, except to the extent necessary to: (1) provide you with the services or products you have requested (e.g., creating a profile or searching for a loan project or capital opportunities), including billing and collections, in accordance with the Terms of Use (“Terms of Use”) or the User Agreement (“User Agreement”); (2) respond to your inquiries or to send you emails from time to time; (3) Operate PCG’s systems properly; (4) Comply with the law or respond to a subpoena, court order, government request, or other legal processes; (5) Protect the interests, rights, safety, or other property of PCG, CapNexus users, or others; (6) Enforce the Terms of Use or the User Agreement; and (7) Facilitate to the sale, merger, or change of control of CapNexus.

Business information (e.g., the originator of a deal or capital opportunity or details thereof) will be handled in the same manner as personal information described above.  You may, however, have the ability to set certain permissions on CapNexus regarding who can view and access such business information (e.g., access to a Document Library).

PCG contracts with third-party service providers and suppliers to deliver complete products, services, and customer solutions.  Suppliers and service providers are generally required to keep confidential the information received on behalf of PCG and may generally not use it for any purpose other than to carry out the services they are performing for PCG.

Non-personal or aggregate information may be shared with any number of parties, provided that such information shall not specifically identify you.

Security

Information security is important to PCG.  We have put in place reasonable physical, electronic, and managerial procedures to safeguard the information we collect.  Only those personnel who need access to your information to perform their duties are authorized to have access to your information.  We use industry-standard encryption via an SSL certification for storage of your information.

To help us protect your privacy, you should maintain the secrecy of the log-in username and password that you create when you register to use CapNexus.

Although PCG will take utmost care to safeguard your information, transmissions made by means of the internet cannot be made completely secure.  We cannot guarantee that communications between you and PCG or information stored on CapNexus or our servers will be free from unauthorized access by third parties such as hackers.  PCG will have no liability for the disclosure of personal information due to errors in transmission or unauthorized acts of third parties.  Your use of CapNexus demonstrates your assumption of this risk.

Acceptance of this Privacy Policy

By using or registering with CapNexus, you are accepting and agreeing to the privacy policies and practices described in this Privacy Policy as it may be revised by us from time to time and at any time.

By providing us with your email address, you expressly consent to receive emails from us. We may use email to: (1) communicate with you; (2) send information that you have requested; or (3) send information about other products or services developed or provided by us or our business partners.  We will not, however, give your email address to another party to promote their products or services directly to you without your consent or as set forth in this Privacy Policy.  You expressly agree that we are free to use any ideas, concepts, know-how, or techniques contained in any communication you send to us without compensation and for any purpose whatsoever, including but not limited to, developing, manufacturing, and marketing products and services using such information.

Changes to Privacy Policy

PCG may change this Privacy Policy at any time.  Each time we change this Privacy Policy, we will post the changes in a revised Privacy Policy as it appears on CapNexus.

How to Opt-Out

To opt-out of all messages from CapNexus, you must also terminate your account as set forth in the User Agreement.  Should you terminate your account, we are not responsible for removing your personal information from the lists of any third party who has previously been provided with your information in accordance with this Privacy Policy or your consent.
